Welcome to SideQuest! By using our platform, you agree to the following terms of service:

1. Introduction

Welcome to Side Quest, a platform that allows individuals to create, assign, and complete quests (challenges or tasks) both in-person and online. By using the Side Quest service, website, or mobile application (collectively referred to as "the Service"), you agree to abide by these Terms and Conditions ("Terms"). If you do not agree with these Terms, you should not use the Service.

2. Definitions

  • User: Any individual who creates, assigns, accepts, or participates in a quest via the Side Quest platform.
  • Quest: A task, challenge, or activity that a User assigns to another User either in-person or online.
  • Questor: Any individual that accepts a Quest on Side Quest.
  • Questee: Any individual that creates a Quest for another individual to accept and complete.
  • Platform: The Side Quest website, mobile application, and any other related services provided by Side Quest.

3. Eligibility

To use the Service, you must be at least 18 years of age or the age of majority in your jurisdiction. If you are under the required age, you may not use the Service unless you have permission from a parent or legal guardian.

4. Account Registration

To participate in quests, you must create an account on the Side Quest platform. By registering, you agree to provide accurate, current, and complete information, and you agree to update your information as necessary to keep it accurate. You are responsible for maintaining the confidentiality of your account information, including your username and password.

5. Acceptable Use

You agree to use the Service solely for lawful purposes and in a manner that does not violate the rights of others. Specifically, you agree that you will not:

  • Assign or participate in illegal, harmful, or dangerous quests.
  • Engage in harassment, abuse, or any discriminatory actions through the platform.
  • Upload or distribute any malware, viruses, or other harmful software.
  • Use the platform to engage in any fraudulent activities.

6. Creating and Assigning Quests

  • As a User, you can create and assign quests to other Users.
  • You must provide clear and complete instructions for each quest you create.
  • Quests should be designed to be safe, legal, and respectful. Side Quest reserves the right to remove any quests that violate these Terms.

7. Completion and Verification of Quests

  • When you accept a quest, you agree to complete it in accordance with the instructions provided by the quest creator.
  • After completing a quest, you may be required to submit proof of completion (e.g., photos, videos, or other forms of verification).
  • The quest creator or the User who assigned the quest will have the right to verify the completion before marking the quest as finished.

8. Payment and Fees

Side Quest may offer premium features, including paid quests, badges, or other services. All payments for these features will be processed according to the pricing listed at the time of purchase. Fees for the quests must be paid by the Questee to Side Quest, Inc. and cannot be transferred to the Questor. Payment terms, if applicable, will be governed by the payment processor's terms.

9. User-Generated Content

By creating, assigning, or participating in quests, you may generate content, including photos, videos, and text. You grant Side Quest a worldwide, non-exclusive, royalty-free license to use, display, and distribute such content in connection with the Service. You retain ownership of your content, but you agree not to infringe upon others' rights.

10. Prohibited Content and Behavior

You are prohibited from creating or participating in any quest that:

  • Promotes violence, hate, or discrimination.
  • Violates the law or encourages unlawful activities.
  • Involves illegal substances or activities.
  • Causes harm to individuals or property.

Side Quest reserves the right to suspend or terminate your account if you engage in any prohibited behavior.

11. Termination

Side Quest reserves the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms. You may also terminate your account at any time by contacting Side Quest customer support.

12. Limitation of Liability

To the fullest extent permitted by law, Side Quest is not liable for any damages arising from your use of the Service. This includes, but is not limited to, any injury, loss, or damage resulting from quests, interactions with other users, or content generated through the platform.

13. Indemnification

You agree to indemnify, defend, and hold harmless Side Quest, its affiliates, and employees from any claims, damages, or losses arising out of your use of the Service, including any violation of these Terms.

14. Privacy Policy

Your use of the Service is also governed by Side Quest's Privacy Policy, which is available on our website. Please review it to understand how we collect, use, and protect your personal information.

15. Changes to Terms

Side Quest reserves the right to modify or update these Terms at any time. Any changes will be posted on this page, and the effective date will be updated accordingly. Your continued use of the Service after any changes to the Terms constitutes your acceptance of those changes.

16. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction of Iowa, where Side Quest is based, without regard to its conflict of law principles. Any legal action or proceeding related to these Terms must be brought in a court of competent jurisdiction in that jurisdiction.
